Fabrics
Our fabric is sold in half-yard increments. Our order minimum is 2 yards. 1 yard or 1.5 yard orders are available with a $25 cut fee. $25 cut fee applies to each fabric quoted under 2 yards. CFA’s are provided with reserves of 5 yards and up. All fabrics are suitable for accessories, drapery and light upholstery. Clients should have their upholstery workrooms advise if knit backing is required. Elizabeth Eakins fabrics are not tested at this time.
Wallcoverings
Our Wallcovering is printed to order in panels up to 5 yards long, 4-6 week’s leadtime with a 15 yard minimum order. Please specify panel lengths upon quoting / ordering.
- Upon receipt of goods, fully inspect all rolls to ensure that you have received the correct color and pattern. All orders must be inspected within 30 days of receipt.
- Check for possible color variations and other technical defects prior to cutting any rolls or hanging any wallcovering.
- Do not cut or hang any material until you have fully read the hanging instructions and undertaken a thorough inspection of the goods.
- No claims are made for material costs after the installation of more than three drops. Absolutely no claims will be accepted for labor or incidental costs.
- Only fully uncut rolls in the original factory wrapping will be accepted for return, provided they are returned within 30 days of receipt. All returns are subject to a 35% restocking fee with freight prepaid.
- We recommend using a Guild-certified wallcovering installer (http://www.wallcoveringinstallers.org/).
- Our painted wallcoverings are handmade, and small variations in color and texture may occur. These are not considered flaws, but beautiful and inherent characteristics of the product.
- Our natural wallcoverings are handmade, small color and fiber variations may occur. These are not considered flaws, but beautiful and inherent characteristics of the product.
- All wallcoverings ship with untrimmed edges and must be trimmed on-site for crisp seams. Please inspect goods thoroughly before cutting as no allowances will be made on trimmed wallcovering.
Rugs
For rugs shipping to a client’s receiver: Freight damage must be reported to the carrier within 72 hours of receipt of merchandise. Damaged carpet must be noted and signed for accordingly. Holland & Sherry / Elizabeth Eakins must be advised of all visible damages immediately. All wrappings must be retained until inspection by carrier. Failure to provide documentation and photographs within the allotted time, shall not render Holland & Sherry / Elizabeth Eakins liable for any costs associated with freight damage.
Careful inspection is made before shipment; however, final inspection and approval are the ultimate responsibilities of the customer. We expect all rugs to be unrolled and inspected by the client’s receiver within five business days of receipt. Any issues must be communicated to Holland & Sherry / Elizabeth Eakins within another five business days. If we do not receive written notification of any damage or irregularity in the goods within 10 business days of receipt at the client’s receiver, we will not assume any responsibility for the condition of the goods.
We strongly recommend that if a rug has been stored for 60-days or more, the client’s receiver should open the rug for airing, grooming, and inspection prior to installation. No claims will be accepted once goods are cut and installed by others.
For rug installations provided by Holland & Sherry / Elizabeth Eakins: A member of the designer’s team must be on-site during the installation to inspect goods with the installer and oversee the installation. Any issues should be immediately communicated to Holland & Sherry / Elizabeth Eakins before completing the installation. Cancelation of installation services within 24 hours of the scheduled delivery date of execution may be subject to cancelation fees. Fees may vary based on situation and project.
Tolerance and Variance: Our rugs are hand-dyed and hand-woven and will have natural variation in color, weave and are subject to a 2″ – 6″ size variance in both width and length. Rugs are not guaranteed against wearing, fading or exact color match. Slight variations may occur between original control sample and current dye lots. All natural undyed fibers are subject to a 15-20% color variance.
Leadtimes: Delivery dates are approximate. Estimated lead times account for production and shipping of goods only. Rush orders (where possible) must be agreed to by Elizabeth Eakins before the order is placed and are subject to a 20% Rush Fee. Rush requests will not be accepted after production begins. Elizabeth Eakins shall not be responsible for any delay in delivery or failure in performance for any cause beyond Elizabeth Eakins’ control (including, but not limited to, labor disputes, failure or delay of sources to supply, transportation difficulties, accidents, fires or acts of God) or any event which interferes with Elizabeth Eakins’ normal business operations. Failure to deliver on the stated date or at a specific time shall not render Elizabeth Eakins liable for damages, lost time, missed installations or any other consequential loss. Installations should be scheduled only once the rug is received at the client’s receiver.
Quoted delivery dates are approximate and Elizabeth Eakins shall not be responsible for any delay or failure in performance for any cause beyond Elizabeth Eakins’ control.
Storage: Elizabeth Eakins will store your rugs for up to 30 days. A $750 charge will be applied to each rug after 30 days of non-delivery.
Terms for Woven To Order Rugs: 50% deposit is required at the time the order is placed. Balance is due upon receipt of invoice, prior to packing & shipping.
Initial rug estimates are subject to changes in rug dimensions, preparation, and freight costs. All rug orders are NON-CANCELABLE & NON-REFUNDABLE and are subject to Elizabeth Eakins’ full terms of sale.
Recommended care: Professional Cleaning (gentle water extraction process; no chemicals)
For General Maintenance: Vacuum your rug at least once a week using a smooth, suction or sweeper attachment. Remember to empty the vacuum cleaning bag when it is half full. Rotate the rug 180 degrees where possible to get a more even exposure to sunlight and wear. We suggest that your rug be cleaned by a trusted professional cleaning company that uses a low moisture water extraction to minimize shrinkage. No harsh chemicals should be used on the rug. Act on removing a stain or spill immediately. The longer you allow the stain to sit, the more difficult it is to remove. Remove as much of the stain/material as possible by blotting with a clean white paper towel or cloth. If necessary, scrape material with a dull knife.
Do Not:
Use beater brushes or rotating vacuums as they may damage the rug.
Shake or beat your rug as this may damage the rug’s pile.
Use laundry machines or dry cleaning to wash your rug as this may cause damage.
Use harsh detergents or chemicals to clean your rug as these may cause chemical discoloration or it will bleach out the rug dyes completely.
Allow water or other liquids to seep into the rug as a wet carpet may attract mold, mildew and other bacteria. Mold and mildew may cause health problems and may damage the rug as well.
Sales Tax
By law, Holland & Sherry and it’s subsidiaries is required to collect sales tax in any state or jurisdiction where we have a corporate office and/or showroom or may otherwise conduct business. Sales tax charges are based on the state or jurisdiction the orders are shipped to, and not the state or jurisdiction the business resides in.
Clients are required to provide a State Resale Certificate or Exemption form to be considered tax-exempt in a specific state or jurisdiction – these can be sent to salestax@hollandandsherry.com. Clients who provide a valid resale certificate will not be charged sales tax when goods are shipped into that state, otherwise, any applicable taxes are required to be paid.
Elizabeth Eakins is responsible for being in compliance with all applicable state and federal laws, including responsibility for paying all applicable state and local taxes imposed on the sales of any applicable products.
Returns
There is no obligation to accept the return of goods ordered in error. Should Elizabeth Eakins make an exception and agree to accept the return of goods, a minimum 30% handling charge will be levied.
All returns must be approved by Elizabeth Eakins and be accompanied by a completed return authorization form. Contact your local showroom for details. Returns will be accepted or credited for items returned only within 7 days from arrival date, if uncut and in the original condition.
Customers must examine goods before cutting or treating, as no allowance will be made after merchandise has been altered in any way regardless of the reason. In no event will any labor costs be accepted. The following merchandise is not returnable:
- Treated or otherwise used merchandise
- Cut merchandise
- No returns on fabric orders less than 5 yards
Refunds
Refunds must be requested in writing. Please allow thirty days from approval of the refund request for the issuance of a refund check. Checks cannot be returned to anyone but the account billed. Credits must be issued to the client’s account.
Quality Limitations
Our merchandise is not guaranteed against fading or shrinkage through cleaning, steaming, and exposure to the sun or the effects of wear. Elizabeth Eakins is not responsible for precise color matching due to possible spinning, yarn, weaving, or dye lot variations. It is the buyer’s responsibility to request cuttings of current stock for approval, especially when ordering coordinating textiles.
We are not responsible for the application or installation of Elizabeth Eakins merchandise. Our textiles are not treated or backed. Costs and arrangements for all special treatments are the responsibility of the buyer.
Claims
All claims against Elizabeth Eakins, including defects, shortages, and errors, must be made within seven days after receipt of the merchandise. Failure to make any claim within such period shall constitute acceptance of the merchandise and a waiver of said defects, shortages, errors, or other claims. No claim shall be made in any event if the merchandise has been cut, fabricated, installed, or treated. Elizabeth Eakins’s liability shall not exceed the contract price and Elizabeth Eakins shall in no event be liable for labor charges or any other consequential damages.
